Anthropic Continues Legal Battle with Pentagon After Being Labeled a U.S. National Security Threat
The company claims this is retaliation for refusing to use its models for military purposes

AI model developer Anthropic has filed a motion for a rehearing in its case against the Pentagon. Late last month, a Washington appellate court rejected the company’s appeal against its designation as a U.S. security threat by a majority vote.
Anthropic asserts that the court ignored evidence of retaliation by the military. The company’s leadership had previously opposed using its models for selecting military targets and surveilling citizens.
In August, a California court ruled in favor of Anthropic, but lifting the restrictions required a victory in Washington as well. The Washington court concluded that the company could block functions of its AI model, Claude, necessary for national security. Anthropic’s attorneys argue that the Pentagon misinterpreted the law, applying it to all contractors rather than only foreign agents.
A decision on the motion for a rehearing has not yet been made.
